E-books trial judge ‘doesn’t want to intrude much on how Apple does business’

According to the in-court report, Judge Denise Cote, who is overseeing the e-books case involving  Apple and the Department of Justice, said that she does not want to “intrudce much on how Apple does business”.

The statement, submitted on Friday, appeared after the DOJ’s revised remedy was reviewed.

“I want this injunction to rest as lightly as possible on how Apple runs its business,” Judge Cote said at Tuesday’s hearing.
According to the revised proposal, Apple submitted a court filing calling the latest proposed fixes for its damage to the industry as “broadside masquerading as a brief”. Moreover, the company also accused the Department of Justice in providing Amazon with a competitive advantage.

Apple is expected to be demanded to bring in a monitor to review the company’s antitrust compliance program. Judge Cote noted, that the monitor is important because of the company’s “blatant” antitrust violations.

Apple has already agreed to certain proposed remedies, including a staggering of talks with e-book providers. Meanwhile, the DOJ cut a proposed ten year injunction to five years.
The injunction is expected to be issued next week.

Apple has stated that the company won’t stop disagreeing with her antitrust finding and plans to pursue its appeal.
